Is it fair to convict O.J on false pretenses of a crime he was acquitted of 13 years ago?

We all know he will go to jail the murders he was acquitted of more than a decade ago. This kidnapping story is false and was a set up and he was stupid enough to fall in the trap. But is it fair to sentence him for that crime (we all know that's what this whole thing is about) instead of the fabricated "kidnapping" story against him now?
